1 warranty of quiet possession
юр., торг., брит. гарантия мирного владения* (положение английского коммерческого законодательства, в частности, закона "О продаже товаров" от 1979 г., согласно которому, покупатель товара вступает в права мирного владения товаром за исключением тех случаев, когда это может быть оспорено собственником или иным лицом, имеющим законный интерес в товаре на предмет обязанности покупателя нести расходы по закладной товара или иные расходы, связанные с владением товаром, во всех случаях кроме тех, когда товаром является доля в собственности; данное положение преследует цель оградить покупателя от затрат, превышающих цену товара, напр., если покупатель автомобиля вынужден платить за этот автомобиль таможенную пошлину, это может быть либо признано незаконным, либо попадает под случай, когда лицо имеющее, законный интерес в товаре (таможенная служба), может обязать покупателя нести иные расходы; положение не вполне ясно и по-разному трактуется судебными прецедентами, кроме того оно сталкивается с проблемой случая, когда продавец не является собственником)See:Англо-русский экономический словарь > warranty of quiet possession

юр., торг., брит. гарантия свободы от залога* (положение английского коммерческого законодательства, в частности, закона "О продаже товаров" 1979 г., согласно которому товары, продаваемые в силу договора о продаже товаров, являются свободными и будут оставаться свободными во время перехода прав собственности от продавца к покупателю от залога и любого вида обложения независимо от того, известно об этом покупателю или нет до подписания договора, за исключением тех случаев, когда в качестве товара выступает доля в собственности; данное положение имеет цель оградить покупателя от расходов, больших, чем цена товара, напр., если покупатель будет вынужден еще нести расходы по выкупу купленного им товара из заклада, договор о продаже товара становится незаконным)See:Англо-русский экономический словарь > warranty of freedom from encumbrances
